Former MLA Seeks to Withdraw Resignation Amid Legal Turmoil

In a surprising turn of events, former Ambasamudram MLA Esakki Subaya has moved to withdraw his resignation—a decision that now hangs in legal limbo as the Madras High Court refused to accept his latest submission.

Court Rejects Late Filing

The first Division Bench of Chief Justice Sushrut Arvind Dharmadhikari and Justice G. Arul Murugan made it clear they wouldn't entertain fresh pleadings once oral arguments had begun. "We will not take anything on record because the matter is already part heard," the Chief Justice stated firmly.

Why the Change of Heart?

Subaya's affidavit revealed his concern for the Ambasamudram constituency, which has been without representation due to multiple ongoing lawsuits. He emphasized that prolonged litigation has stalled local governance, public welfare schemes, and development projects—leaving voters in a frustrating democratic vacuum.

"Confronted with the vacuum in representation and considering the pressing needs of the constituency, I addressed a formal representation/letter dated August 29, 2026 to the Hon'ble Speaker."

His request to the Speaker was practical: either let him resume duties pending judicial outcomes or permit full withdrawal of his resignation.

Legal Context

The case originates from a challenge by AIADMK whip Agri S.S. Krishnamurthy against the Speaker's acceptance of resignations from six party MLAs, including Subaya, between May and June 2026. Complicating matters further, an election petition contests Subaya's original victory, while another PIL has temporarily blocked by-elections in five affected constituencies.

With the court reserving its orders after hearing arguments from all sides, the people of Ambasamudram continue waiting—their political representation suspended between a resigned MLA's change of heart and the slow wheels of justice.
